2 26-04-2016Heard learned counsel for the petitioner and the learned counsel for the State.
In this case the petitioner seeks bail in Kadamkuan P.S.Case No. 513/2014 instituted for the offences under section 366A/34 of the Indian Penal Code.
Allegation has been made that the victim was kidnapped by the petitioner with the help of his friends while she was going to the school. She was served tea and after taking tea she was feeling uncomfortable. She wanted to go to the School but the present petitioner had gone alongwith the victim in the three- wheeler and she became unconscious. She was carried to Delhi and thereafter she was taken to Ludhiyana. She was rescued by her father at Ludhiyana. In the statement under section 164 of the Cr.P.C. she has narrated the whole story. Learned counsel for the petitioner has produced the photograph showing good relationship of the petitioner with the victim.
Having considered the facts and circumstances of the case, let the petitioner, Amar Kumar, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate, 1st Class, Patna in Kadamkuan P.S.Case No. 513/2014.
