Section 51(1) in Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014

(1)Recovery of cost of hedging or foreign exchange rate variation shall be made directly by the generating company or the transmission licensee, as the case may be, from the beneficiaries or the long term transmission customers /DICs, as the case may be, without making any application before the Commission:Provided that in case of any objections by the beneficiaries or the long term transmission customers /DICs, as the case may be, to the amounts claimed on account of cost of hedging or foreign exchange rate variation, the generating company or the transmission licensee, as the case may be, may make an appropriate application before the Commission for its decision.
