Heard on I.A. No.10086/2023, application seeking temporary suspension of sentence filed on behalf of the appellant Bablu Yadav.

It is submitted that marriage of appellant's daughter Khushbu has to take place with Shankar Pratap on 06th June, 2023 at village Nadgaayn Kalan, District Chhatarpur (M.P.).

It is submitted that appellant being father of the prospective bride, his presence is mandatory.

Shri Ajay Shukla, learned Government Advocate opposes the prayer. However, he submits that State has obtained verification in regard to the factum of marriage to be performed on 6th June, 2023.

Accordingly, it is directed that appellant Bablu Yadav S/o Shri Bhaggu Yadav be taken in custody for performance of rituals of marriage of his daughter on 6th June, 2023 so to reach the place of marriage at 10.30 a.m. and he shall be allowed to remain there till morning of 7th June, 2023 and after vidaai, will be lodged back to the jail on 7th June, 2023.

In above terms, I.A. No.10086/2023 is disposed of. At this stage, learned counsel for the appellant requests that if the Signature Not Verified SAN appellant is sent to the marriage ceremony in handcuff state that may cause Digitally signed by PUSHPENDRA PATEL Date: 2023.05.23 20:44:05 IST embarrassment to the family.

Taking this fact into consideration, an option is given to the appellant that if he so desires not to participate in the marriage function in accordance with rules and regulations made in this behalf by the jail authority/police, then he may refuse to go to attend the marriage ceremony and jail authority shall respect his sentiments.
