ORDER
1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO) New India Assurance Company Limited, Chennai seeking following information:-
" The information required are pertains to crop insurance PMFBY scheme for Rabi 2016-2017 villages at Nagapatnam District, Tamil Nadu.
1. Disbursement of claim for Rabi 2016-2017 has been completed or not. If completed then at what date completed. If not when will it will be completed.
2. Furnish village wise details of actual crop loss in percentage or value (based on details furnished by Government) and scale down percentage or value of disbursement done by you in Nagapattinam Distt.
3. Disbursement- has it been done based on the above order or not.
4. If the above order is considered then list the disbursement claim in % for each village specified in that order.
5. In case of the above order has not taken into consideration by your specify on whose authority you have done the calculation for scale down disbursement.Page 1 of 3
6. Furnish the list of villages with the area insured in Nagapattinam District for which the scale down disbursement claim is less than 35%."
2. The CPIO responded on 11-01-2019. The appellant filed the first appeal dated 20-01-2019 which was disposed of by the first appellate authority on 11- 02-2019. Thereafter, he filed a second appeal u/Section 19(3) of the RTI Act before the Commission requesting to take appropriate legal action against the CPIO u/Section 20 of the RTI Act, 2005 and also to direct him to provide the sought for information.
Hearing:
3. The appellant, Mr. R. Narayanan attended the hearing through audio conferencing. Mr. A Thajulal, CPIO participated in the hearing representing the respondent through audio conferencing. The written submissions are taken on record.
4. The appellant limited his submissions on providing the information on point no. 1 regarding status of disbursement of crop insurance claim under PMFBY scheme for Rabi 2016-17 for villages of Nagapatnam District, Tamil Nadu.
5. The respondent agreed to provide a revised reply to the appellant on point no. 1 regarding status of disbursement of crop insurance claim under PMFBY scheme for Rabi 2016-17 for villages of Nagapatnam District, Tamil Nadu, within a period of 15 working days from the date of receipt of this order. Decision:
6. This Commission directs the respondent to provide a revised reply to the appellant on point no. 1 regarding status of disbursement of crop insurance claim under PMFBY scheme for Rabi 2016-17 for villages of Nagapatnam District, Tamil Nadu, within a period of 15 working days from the date of receipt of this order.
7. With the above observations, the appeal is disposed of.
8. Copy of the decision be provided free of cost to the parties.
