03Heard Mr. Mohanty, learned counsel appearing on behalf of Mr. L. Samantaray, learned counsel for the petitioner; Mr. B.P. Tripathy, learned Addl. Government Advocate appearing for State opposite parties no.1 and 2; and Mr. L.K. Mohanty, learned counsel appearing for opposite party no.3.
The petitioner, by means of this writ petition, seeks direction to the opposite parties to pay the arrear wages for the period from July, 1999 to May, 2000 and bonus for the year 1998-99, 1999-2000, 2001-2002, 2002-2003, as mentioned in paragraph-9 of the writ petition, along with 12% interest, within a stipulated time.
Mr. L.K. Mohanty, learned counsel appearing for opposite party no.3 contended that in view of order dated 21.03.2017 passed by the apex Court in SLP No. 354 of 2009, all the benefits, as admissible to the petitioner, have already been paid and, as such, nothing remains to be considered by this Court in the present writ petition.
Mr. Mohanty, learned counsel for the petitioner contended that this matter is of the year 2013 and he has no instructions whether the petitioner has received the benefits or not.
Considering the contentions raised by learned counsel for the parties, since the benefits, as admissible to the petitioner, have already been released, pursuant to the order dated 21.03.2017 passed by the apex Court in SLP No. 354 of 2009, this Court does not find any reason to keep this matter pending.
The writ petition is accordingly disposed of. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No. 4798 dated 15th April, 2021.
