44. Uncontested Elections.
(1)If for any seat, after the date and time fixed for withdrawal of nomination paper there remains only one candidate whose nomination paper is found to be valid the Returning Officer shall forthwith declare in Form 27 the candidate duly elected to fill such seat and inform the District Election Officer of the same.(2)If no nomination paper has been filed for any seat or if no candidate has been duly nominated for any seat, the Returning Officer shall send a report of this fact to the District Election Officer who shall take further action to fill such seat in accordance with the provisions of the Act and these rules.
