- A Government Officer against whom a suit is instituted in respect to anything purporting to have been done by him in his official capacity without the notice required by Section 80, Civil Procedure Code, having been duly served on him, should, as a rule, move the Court to dismiss the suit, on the ground that it has been instituted contrary to the provisions of that section.
