ORAL ORDER
1. Heard Mr. Shah, learned advocate for the applicant and Mr. Mehta, learned advocate for the respondent.
2. Learned advocate for the applicant submitted that the applicant preferred present application with a request to permit the applicant to condone the delay in preferring the application being Page 1 of 2 C/MCA/2979/2014 ORDER Civil Application No.6332 of 2014 wherein, the applicant prayed for permission to join - as party respondent - in the petition being SCA No.16/2014. However, since the said main petition being SCA No.16/2014 is already disposed of vide order dated 15.11.2014, the said application being Civil Application No.6332 of 2014 does not survive. Consequently, present application seeking condonation of delay in preferring the application being Civil Application No.6332 of 2014 does not survive and that, therefore, it may be disposed of as infructuous upon disposal of the main petition.
3. In view of the said submissions by learned advocates for the applicant and the respondent, present application is disposed of as infructuous upon disposal of the main petition being SCA No.16/2014 vide order dated 15.11.2014.
