The applicant herein, a Group C Postal Assistant, has been imposed a penalty of recovery of Rs.50,000/- at the rate of Rs.2500/- per month from his salary vide Memorandum dated 29.4.2010. Against this, the applicant has submitted an appeal dated 8.6.2010 (Annexure A/3) on various grounds.

It is incumbent upon the appellate authority to apply his mind to each and every issues raised in the appeal and take a considered decision in the matter according to the rules, and pass orders thereon within a reasonable period of time. However, it is noticed that although a period of over a year has elapsed, the appellate authority has not issued any order on the appeal of the applicant.
3. We, therefore, dispose of this OA at the admission stage itself by directing the respondents through Shri Rattan Lal, who is present in the Court on behalf of the respondents, to look into the appeal of the applicant dated 8.6.2010 as well as the supplementary issues raised in the present OA and take a considered decision thereon in accordance with the rules, and pass appropriate orders on the appeal within a period of 10 weeks from the date of receipt of a certified copy of this order. However, it is made clear that we have not gone into the merits of the matter and the directions issued as aforesaid would not prejudice the rights of the respondents in any manner whatsoever.
3. The Application is disposed of in the above terms.
