% 31.10.2022 This is an application filed seeking grant of interim bail for a period of one month in the FIR No. 436/2020 dated 31.08.2020 registered at PS Shahbad Dairy under Section 302/396/411/120B/34 IPC.

It is stated that the petitioner has a medical ailment and is requiring Hernia surgery.

Mr. Singh, learned APP has filed a status report, wherein it has been stated that the applicant is requiring a Hernia surgery, but there is no confirmed date of surgery.

Mr. Kumar, learned counsel appearing for the applicant has stated that he was granted interim bail on an earlier occasion, but since the date of proposed surgery was post the bail period, he was unable to get his operation.

He further states that in case the interim bail is granted to him for a period of 4 weeks, he will ensure that he is operated within the said period of 4 weeks.

The status report submitted is taken on record. In this view of the matter, the application is allowed and the applicant is directed to be released on bail for a period of one month subject to the following terms and conditions to get his Hernia surgery:-

i. The applicant, within 3 days of his release, will approach the hospital and get a date for surgery. The surgery shall be undertaken by the applicant within a period of 4 weeks. ii. The applicant shall furnish a personal bond and a surety bond in the sum of Rs. 10,000/- each, to the satisfaction of the Trial Court; iii. The applicant shall appear before the Court as and when the matter is taken up for hearing;

iv. The applicant shall join investigation as and when called by the I.O concerned;

v. The applicant shall provide his mobile number to the Investigating Officer (IO) concerned, which shall be kept in working condition at all times. The applicant shall not switch off, or change the same without prior intimation to the IO concerned, during the period of bail;

vi. He shall also drop his active pin location to the I.O. concerned; vii. In case there is any change of the residential address, he shall duly inform the I.O. and the Trial Court concerned about the same; viii. The applicant shall not leave the NCR during the bail period. He shall surrender his passport, if any, at the time of release before the Trial Court;

ix. The applicant shall not indulge in any criminal activity during the bail period;

x. The applicant shall not communicate with, or come into contact with any of the prosecution witnesses, or any member of the complainant‟s family, or tamper with the evidence of the case. xi. The applicant shall surrender to the Jail Superintendent on or before expiry of 4 weeks from the date of his release.

The application stands disposed of in the aforesaid terms.
