1. In view of the pendency of similar issue before the Apex Court in "Civil Appeal 2753/2023 titled Commissioner of CGST and Central Excise Mumbai East vs. Flemingo Travel Retail Ltd." as reflected in the last order, we deem it appropriate to defer hearing of the present appeal.
2. We grant liberty to mention, in case, if the issue is decided.
