__________________________________________________________________ Sanjay Karol, ACJ. (oral) Petitioner has challenged the order dated 11.9.2018, passed by the HP State Administrative Tribunal in OA No. 4539 of 2017, titled Dr. D.D. Gupta v. State of HP and Ors.
2. After the matter was heard for some time, with the consent of the parties, present petition stands disposed of on the mutually agreed terms:-
a) Grievance of the petitioner Dr. P.K. Kaundal that the DPC did not peruse and consider the entire ACRs of the respondent prior to its recommendations stands seriously refuted by the State. Be that as it may, it is mutually agreed that all the ACRs for the relevant years of both the writ petitioner Dr. P.K. Kaundal, as also private respondent No.3 Dr. D.D. Gupta, shall be considered by the DPC, which shall convene its meeting within next one week, whereafter fresh recommendation shall be made.

b) With such recommendation having been made by the .
DPC, it shall be open for the respondent-State to fill up the posts of Professor, Pharmacology in IGMC, Shimla. This shall be positively be done within a period of one week thereafter.
3. Accordingly, OA No. 4539 of 2017, titled Dr. D.D. Gupta v.
State of HP and Ors, is deemed to have been disposed of. However, parties shall apprise the learned Tribunal with regard to passing of the order.
Present petition is also disposed of clarifying that we have not expressed any opinion on the merits of the case. Liberty is also reserved to the petitioner to take recourse to such remedies as are otherwise available in accordance with law. Pending applications, if any, also stand disposed of.
