1. The learned counsel for the Appellant submits that in terms of the order dated 09.09.2019 passed by the Debts Recovery Tribunal, Jabalpur (for short 'the Tribunal), a copy of which has been produced as Annexure A/5, the Appellant has satisfied a total sum of Rs. 17,00,000/- as against a total 2 liability of nearly Rs. 27,00,000/-. The learned counsel submits that the Appellant wants to file appropriate proceedings before the Tribunal for seeking some relaxation/modification so as to enable the Appellant to wipe off the entire liability to the Respondent-Bank. In the said circumstance, permission is sought for to withdraw the appeal and to move the Tribunal, as above.

2. Permission is granted.

3. The writ appeal is dismissed as withdrawn.
