Instant petition is nothing but a lost battle and has been filed under the belief that if the bonus marks would have been awarded in the subject of Medicine & Surgery in MBBS Part II Examination of July-2009, she could have finally qualified in MBBS and the stage of re-evaluation could be avoided.
Counsel submits that if this mistake would have been properly appreciated by the respondents at the stage when the result of MBBS Part-II Examination of July-2009 was declared, the stage of Revaluation Examination of MBBS Part II could be avoided.
This fact has not been disputed that the petitioner finally qualified MBBS Part II and marks sheet has been issued to her. However, after issuing notices, reply has been filed and the respondents have justified that the marks were rightly awarded and apart from it, after the petitioner has qualified MBBS Part-II Examination and marks-sheet has been issued, may be at later stage, there appears no justification for this Court to now examine the issue after it being settled by the passage of time and in these changed facts and circumstances, controversy remains academic to be examined in the instant petition.
Consequently, the petition, being devoid of merit, is accordingly dismissed.
