O R D E R
Petitioner is the 5th accused in Crime No.1094 of 2013 of the Kollam East Police station for the offences punishable under Secs.489A,B and C read with Sec.34 of the Indian Penal Code, is in custody from 02.12.2013 and seeks bail.
2. The application is opposed by the learned Public Prosecutor. It is submitted that accused nos.1 and 2 were found in possession of 986 numbers of counterfeit currency notes of 1000/500 rupee denominations and that involvement of the petitioner was revealed from the statement of some of the accused arrested and questioned. It is submitted that investigation is recently taken over by the Crime Branch and hence further questioning of the petitioner may be necessary. The 3rd accused is still absconding.
3. Learned counsel submits that the petitioner is in custody from 02.12.2013 and that accused nos.1 Bail Appl. No.573 of 2014 2 and 2 from whom the counterfeit currency notes were allegedly seized are released on bail.
4. Having regard to the nature of allegations made against the petitioner, as investigation of the case is taken up by the Crime Branch only recently, further interrogation of the petitioner may be necessary, request for bail cannot be allowed at this stage. It is made clear that at a later stage of investigation it is open to the petitioner to move again either in the Sessions Court concerned or in this Court for bail.
The application is dismissed with the above observation.
