WPMS No. 1640 of 2016 U.C.Dhyani, J.
[Mr. R. P. Nautiyal, Senior Advocate, assisted by Mr. B. S. Koranga, Advocate, present for the writ petitioners.
Mr. P.C. Bisht, Standing Counsel, present for the State.
By means of present writ petition, the petitioners seek writ in the nature of mandamus directing the respondents to conclude the process pertaining to the verification of the petitioners as "Uttarakhand Rajya Andolankari" in a time bound manner within the time limit prescribed by this Hon'ble Court.
Learned counsel for the petitioners submitted that though the names of the petitioners figured in the newspaper cuttings as agitators, during the course of agitation for creation of separate State of Uttarakhand, still the present petitioners are not being issued the Uttarakhand Rajya Andolankari Identity Cards, as no final decision has yet been taken by the respondents in this regard. Learned counsel for the petitioners also submitted that respondent authorities are forwarding the names of the other similarly situated persons for granting the identity cards of "Uttarakhand Rajya Andolankari", but due to pendency of the present writ petition, respondents are not considering the name of the petitioners. Lastly it is prayed that direction may be issued to the respondents to conclude the process pertaining to the verification of the petitioners as "Uttarakhand Rajya Andolankari" and identity cards be issued to them at the earliest.
Learned counsel for the State submitted that in case such a direction is issued by the Court the respondent authorities shall comply with the same.
The respondents are, accordingly, directed to conclude the process pertaining to the verification of the petitioners as "Uttarakhand Rajya Andolankari". Present writ petition will not come in the way of the petitioners being considered for being issued Identity cards for said purpose. Entire exercise shall be concluded within a period of two months from the date of production of a certified copy of the order before the respondent authority.
Writ petition stands disposed of accordingly.
