ORDER
This revision petition is by the complainant questioning the judgment passed by the Sessions Court acquitting the respondent-accused of the allegation under Section 138 of the N.I. Act. In view of the ratio of law in the case of K.H.GANESH RAO vs. H.GOPAL, 2011(1) Kar.L.J. 652 (DB), revision petition is not maintainable and the complainant-petitioner if aggrieved, has to prefer an appeal against the order of acquittal passed by the Sessions Court, with the leave of this Court under Section 378 of Cr.P.C.
Consequently, petition stands dismissed as not maintainable. Petitioner is granted liberty to prefer a 3 criminal appeal against the impugned judgment. Time taken to prosecute this revision petition from 10.03.2010 till date, shall stand excluded, if an application seeking condonation of delay is filed and an appeal is preferred within a period of 10 days from today.
