(2)Where the Admission Regulatory Committee, on receipt of any complaint or otherwise, is satisfied that the management of an institution or any person in charge of it or is responsible for the management of such institution, has violated the provisions of sub-section (1), it may, after conducting an enquiry, recommend to the Government for taking penal action against the institution or the management.
