The petitioner says that some influential persons, who had business relationship with the petitioner's father, have instigated various police stations in the district of Howrah to register cases as against the petitioner. The petitioner has stated in the writ petition about three cases, one being Amta Police Station Case No.348/19 dated 14.09.2019 under Sections 341/354/379 of the Indian Penal Code (in short IPC), 1860, the second being Liluah Police Station Case No.262/19 dated 15.10.2019 under Section 377 of the IPC and Section4/6 of POCSO Act, 2012 and Uluberia Police Station Case No.1/20 dated 01.01.2020 under Section 376D/506 of the IPC. The 2 petitioner says that he is being harassed by filing criminal cases one after the other in different police stations by those influential persons. Petitioner says, though not on record about two First Information Reports (FIR) having been filed against him prior to filing of the writ petition which he allegedly came to know after filing of the writ petition. The petitioner has, however, not made such "influential persons" as parties to the writ petition though he has spoken about one Rabi Kumar Almal in the writ petition. Be that as it may, since criminal cases have been registered against the petitioner, it is necessary to know the stage of each of the cases before the prayer of the petitioner to consolidate the said cases for being investigated by a single agency can be considered. On behalf of the State respondent, it is orally submitted that Amta P. S. Case No.348/19 is at the trial stage while the Liluah P. S. Case No.262/19 has ended by the police authorities filing a report to the Magistrate under Section 173 of the Code of Criminal Procedure (Cr. P. C.), 1973. So far as the Uluberia P. S. Case No.1/20 is concerned, it is submitted that charge-sheet has been filed.
Since the matter is heard on virtual mode and the report received by the advocate for the State from the various Police Stations as to the status of such cases is not available before the Court, the matter is adjourned 3 till 30th April, 2021 to enable the advocate for the State to send the report said have been received by him from the three police stations respectively, being Amta Police Station, Liluah Police Station and Uluberia Police Station to Court before the matter is taken up on the returnable date.
Let this matter appear on 30th April, 2021.
