This is a writ petition that has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the Department authorities to decide the agenda dated 20.07.2020 relating to the promotion of the petitioner and other employees without delay.

Learned counsel for the petitioner herein would contend that as per the ACRs of the petitioner, she has been receiving the outstanding remarks for her services. Based on that, agenda dated 20.07.2020 has been prepared regarding promotion of the petitioner, however, the said agenda is not being considered. It is argued that the petitioner is due to retire on 31.08.2020 and her case for promotion should be considered on the basis of agenda already prepared. It is submitted that after the agenda has been 1 of 2 ::: Downloaded on - 04-09-2020 06:18:20 ::: CWP-12644-2020 -2- prepared, no action has been taken on it. Thereafter, the petitioner has moved a representation for the consideration of the agenda item, however, again no action has been taken thereon. It is submitted that the petitioner would be satisfied in case, this petition, her representation and the agenda item are considered prior to her retirement i.e. 31.08.2020.

Notice of motion.

At this stage, on the asking of the court, Ms. Lavanya Paul, AAG Punjab, accepts notice on behalf of the respondent-State and admits to the factum that agenda item has been prepared and that the petitioner herein would be due for promotion.

Having heard learned counsel for the parties, this court is of the view that a person, whose promotion is due should be given the same in due course instead of being made to wait. Considering the fact that the agenda item has already been prepared, let the same be decided by the respondent- State prior to the retirement of the petitioner herein and in case, the petitioner is found entitled, necessary relief be given to her accordingly.

The petition stands disposed of with the aforesaid directions.
