Perused the report received from the trial court.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is languishing in custody, seeks bail in a case registered for the offence under Sections 20, 22, 23, 27(A) and 29 of the N.D.P.S. Act, is solitary named accused in this case.

On perusal of the report received from the trial court, it appears that the trial is at its conclusion and only three witnesses are left to be examined.

Having regard to the facts and circumstances of the case, for the present, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer for regular bail of the above named petitioner, in connection with Trial No. 31/2011 arising out of Bhangaha P.S. Case No. 32/2010, pending in the court of learned IIIrd Additional Sessions Judge, Bettiah, West Champaran, is hereby, refused. Simultaneously, the trial court is directed to proceed expeditiously with the trial and preferably conclude the same within three months.
