                                ORDER

The Writ Petition is filed to declare the action of respondents for interfering with the possession of petitioner's property bearing D.No.9-419 in S.No.134-11 in Visalakshi Nagar, Visakhapatnam, without following due process of law, as illegal and arbitrary.

2. The writ petition is filed on 08.11.2023. Pending the writ petition, the petitioner gave consent to handover an Page 2 of 2 SRSJ WP No.29464 of 2023 extent of 24.51 square meters portion of property, which is affected in road widening i.e. 60 feet road from Hanumanthuwaka Junction to Kailasagiri Road and the same extent was demolished. The letter addressed by the petitioner to the 4th respondent was served by the learned counsel for petitioner on the learned Standing Counsel for respondents 4 to 6 and he endorsed the same.

3. Learned Standing Counsel for respondents 4 to 6 would submit that the Corporation will issue TDR certificate by following due procedure.

4. In view of developments pending the writ petition, the Writ Petition is disposed of directing the respondent- authorities to consider the case of petitioner and issue TDR certificate to the petitioner for the extent of portion affected in road widening. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
