These Original Applications and Contempt Petition having been heard on
11.09.2018 the Tribunal on 26.09.2018 delivered the following:
ORDER
Per: E.K. Bharat Bhushan, Administrative Member:
As the nature of relief sought and the pleadings advanced by the respective parties are similar and near-identical, they are being considered through this common order.
2. These OAs are filed by Loco Pilots who have put in their requests for other divisions of choice within Kerala and are awaiting placement orders. The issue relating to the induction of Loco Pilots working in one Division of Southern Railway and wanting to join another Division of their choice and their placement ahead of fresh personnel coming through General Department Competitive Examination (for short GDCE) has been engaging the attention of this Tribunal.
3. The applicants in OA No. 180/1053/2017 are all Assistant Loco Pilots (ALPs for short) working under Salem Division of Southern Railway. The applicants, 32 in number, have all applied for Inter Divisional Transfer (IDT for short) to Palakkad Division against direct recruitment quota. One batch of respondents have been selected by the Railway Recruitment Board, (RRB for short) Bangalore, but have shown Palakkad as the divisional choice. The 21 applicants submit that these respondents ought to be considered only for South Western Railway. Respondents 22 to 32 are ALPs selected through GDCE and allotted to Palakkad Division. Their appointment to Palakkad Division according to the applicants would result in denial of the applicants' claim.
4. In OA No. 180/202/2018 the applicants, 15 in number, are ALPs currently working in Palakkad Division and are applicants for transfer on IDT to Trivandrum Division. They are aggrieved by candidates by recruits coming through GDCE being posted to Trivandrum Division ahead of the applicants thereby jeopardizing the applicants' priority.
5. OA No. 180/813/2017 is filed by 25 ALPs of Salem Division who have applied for IDT to Trivandrum Division. They also apprehend that induction of fresh recruitees would result in the applicants' losing their priority for transfer.
6. OA No. 180/880/2017 are filed by 25 ALPs of Palakkad Division who have registered for IDT to Trivandrum Division against direct recruit vacancies. Their grievance against the GDCE recruitees are similar as those of the applicants in other OAs.
7. The applicants in the four OAs referred to above are all aspirants for Palakkad and Trivandrum Divisions which are two of the six Divisions of the Southern Railway. They have put in their request for IDT to Divisions of 22 their choice while working in their parent Divisions. There are IDT registration priority lists maintained in each of the Divisions. These indicate the personnel who have applied for transfer out of those divisions as well as personnel who have applied for transfer to those divisions. The applicants herein have registered for transfer out of the respective Divisions and is now forced to confront a situation where fresh inductees coming through GDCE examination are steeling a march over them and getting posted to the divisions the applicants have opted on transfer.
8. At the core of the demand of the applicants is their contention that they ought to be inducted into the Trivandrum/Palakkad Divisions in preference to the GDCE recruitees. They maintained that they are senior in service and are experienced operators of trains. Besides, as they will be placed at the bottom of the seniority list once they join the new Division, the fresh recruitees being posted before them would eventually become senior to them, despite the applicants having many years more of career experience.
9. In reply the respondents have maintained that under Rule 226 of Indian Railway Establishment Code Volume I, Chapter II an employee cannot claim transfer as a matter of right. In fact it is a benefit bestowed upon the employee at the employer's choice. The relevant rule is quoted below:
"Ordinarily, a Railway servant shall be employed throughout his service on the Railway or Railway establishment to which he is posted on first appointment and shall have no claim as of right for transfer to another Railway or another establishment."23
10. It is stated that in OA No. 180/902/2010 a direction had been issued by this Tribunal that applicants' case for transfer should be considered on a priority basis over that of fresh recruits. But specific difficulties abound in considering this direction as an inviolable principle. What the respondents have been attempting to do is to deal with this issue in as a judicious manner as possible.
11. It is wrong on the part of the respondents to assume that all existing vacancies are going to be filled up by fresh recruitees. This is a step which will not be resorted to particularly in view of safety issues involved. What the respondents had attempted to do is to strike a balance between the demand of IDT transferees and deployment of fresh recruitees.
12. When OA No. 180/1053/2017 was considered an interim order was issued on 26th February, 2018 requiring the respondents, the authorities in Palakkad Division, to maintain status quo till the next posting date. It appears that it is disregarding this direction that the respondents therein issued an order placing 14 RRB candidates freshly recruited, at Palakkad Division. The applicants in OA No. 180/1053/2017 have filed a Contempt Petition No. 180/31/2018 alleging direct violation of the interim orders issued by this Tribunal.
13. We have heard Shri Harikumar G. Nair, learned counsel appearing for the applicants in OAs Nos. 180/1053/2017, 180/813/2017, 180/880/2017 and CP(C) No. 180/31/2018, Shri T.C. Govindaswamy learned counsel appearing 24 for the applicants in OA No. 180/202/2018, Smt. Sumathi Dandapani, Sr. along with Shri Sunil Jacob Jose learned counsel appearing for the respondents 1-4 in OAs Nos. 180/1053/2017 and 180/202/2018 and CP(C) No. 180/31/2018, Shri S. Radhakrishnan, learned counsel appearing for the respondents Nos. 1-4 in OAs Nos. 180/813/2017 and 180/880/2017, M/s. Varkey & Martin learned counsel appearing for respondents Nos. 26 & 27 in OA No. 180/1053/2017 and Mrs. Shameena Salahudheen, learned counsel for the respondents Nos. 5-13, 15 & 16 in OA No. 180/813/2017 and respondents Nos. 5-13 and 15 in OA No. 180/880/2017. Perused the records.
14. This is not the first occasion when this Tribunal has been called upon on to adjudicate the issue of inter Divisional Transfers in the Southern Railway. The continuing controversy surrounding this matter has been the priority or preference demanded by request transferees over placement of the fresh recruitees. This Tribunal on 17 th February, 2012 in OAs Nos. 902/2010, 40/2011, 135/2011, 598/2011, 646/2011, 656/2011, 740/2011, 744/2011, 772/2011, 836/2011, 837/2011 and 880/2011 attempted to strike a balance between the competing claims and prescribed thus:
"20. Before parting with the case, the Tribunal feels that certain concrete and fool- proof method should be adopted in matters of transfer on Inter Divisional Transfers. In Southern Railway there are as many as six Divisions and sufficient number of applications for inter divisional transfer are stated to have been pending. It is not exactly known whether full transparency has been maintained with regard to such registration. With the technological advancements in communication technology and with profuse use of computer in the Railways, it should not pose any difficulties to the Railways, a massive organization, in having online registration for inter divisional transfer. The Railway Board may consider introducing the same in the following manner or in any other better manner, so that the same would enhance the faith of the employees in the very system.
(a) Online registration after the recommendations of the DRM concerned, at a centralized office (preferably in the office of Chief Personnel Officer, Southern Railway, 25
(b) Computerized Registration Number serially to be given to each applicant
(c) Periodical review (preferably once in two months) of the Register and ascertaining whether there is any possibility of mutual transfers among the applicants.
(d) Annual review of applications to call for withdrawal of applications
(e) Assessing the number of Direct Recruitment vacancies in various Divisions and matching the same with the pending applications.
(f) Prescribing number of vacancies that could be allotted for transfer purposes (preferably by amendment to the Rules) with a rider that vacancies of the previous year unfilled by the other mode, i.e. open market recruitment and GDCA would be diverted to recruitment by transfer.
(g) Where for administrative reasons transfers are effected (punitive in nature), deletion of the names of such individuals from the Register
(h) Seniority of the transferred individuals to correspond to the date of their registration (subject to their joining within a fortnight from the date of their transfer order)
(i) GDCE selected candidates may not be accommodated in those Divisions in respect of which, transfer requests are the maximum.
21. The above is purely a suggestion emanating from this Tribunal since the Tribunal receives a number of applications in respect of request transfer."
15. After examining the contentions made by both sides and the arguments advanced in the OAs as well as in the reply statements, we are convinced that the problem requires a holistic remedy. The Railways who are the official respondents certainly have compulsions of their own. In order to understand these and to help arrive at a suitable solution we ordered the presence of the Chief Personnel Officer of Southern Railway Headquarters so that this Tribunal could directly question him on the implications involved. In compliance Shri G. Sreenivasa Rao, Chief Personnel Officer/Administration, Southern Railway, Chennai appeared before this Tribunal on 11.09.2018. He 26 has also filed similar affidavits in all the OAs wherein the plan of action being adopted by the Southern Railway in their attempt to accommodate the transferees and direct recruitees without compromising the smooth operation of trains have been dealt with. In the said affidavit he submits that the sanctioned strength of Loco Pilots in the Southern Railway is 4,798 and the total incumbents are 4,275 whereby the vacancies are 523. There are 402 inter-divisional transferees from one division to another in the Southern Railway registered and waiting as on date. The following table indicates the position:

For example Trivandrum Division has only 66 vacancies whereas 207 people are waiting for IDT.
Palakkad has 52 vacancies and IDT inflow and outflow are rather equal at 64 and 63 respectively. Salem Division from where large number of personnel have asked for transfer out, and 226 have registered for transfer out already has 95 vacancies and none is seeking transfer into the Division.27
16. The Chief Personnel Officer further submits that action has already been completed for recruitment of 176 GDCE candidates and a fresh recruitment for 528 Loco Pilots is with RRB. The respondents expect the entire contingent to be available by the beginning of 2019 after training. The affidavit further goes on to state that respondents are unable to satisfy all the 402 aspirants who have registered for IDT with the overall position being it is and the intention of the Railway authorities is to balance GDCE recruitees induction with transferees of IDT in a manner which would not compromise the safety of operations.
17. We have examined the issue presented in the four OAs from the point of view of the applicants as well as from that of the official respondents. The applicants are waiting for considerable period after having registered for IDT and at the same time the official respondents are hamstrung due to the large number of vacancies and slow pace of induction. We agree with the preposition made by the Railway respondents that a balanced approach is necessary and vacancies cannot be filed up either by one group or the other. In so far as the rights of the applicants being impinged, Rule 226 quoted elsewhere in this order nullifies that contention. No illegality can be put at the door of the Railways for not posting or for delaying the request for IDT.
18. The operational priorities of the Indian Railways, being the largest public utility in the country, cannot be made captive to the location preferences of a group of employees. As already mentioned this Tribunal by its order dated 17 th February 2012 in the batch of cases referred to above, made a set of suggestions for streamlining the process but with the huge gap between requirement and resources available, how far the respondents will be able to cope with the claims 28 of personnel as in these O.As, is not clear.
19. The solution apparently is to balance the induction of fresh recruitees with transfers of ALPs from other divisions on request, in a manner which will not compromise the safety of the running trains. The respondents ought to show greater alacrity in expediting fresh recruitment. At the same time in the interest of fairness they should ensure that IDT is granted on need basis and strictly in accordance with seniority in registration.
20. Again we are of the view that only the respondent Railways will be able to solve this problem in a manner which would ensure that there is least amount of discontent and disaffection. A formula incorporating a ratio may be considered while accommodating the contending segments. At the same time as more and more vacancies would arise in future, fresh recruitment should be expedited.
21. In the circumstances in so far as these O.As are concerned we see no reason to interfere with the action being followed by the respondents. Accordingly the O.As are dismissed as also C.P.No.180/31/2018.
22. The interim orders dated 20.2.2018 in OA No. 180/1053/2017, 23.10.2017 in OA No.180/813/2017, 3.11.2017 in OA No. 180/880/2017 and 22.3.2018 in OA No. 180/202/2018 stand vacated.
