     This Criminal Petition is filed under Section 439 of
the Cr.P.C. praying to enlarge the petitioner on bail in
Cr. No.161/2012 of Sampangi Ramanagar P.S.,
Bangalore city, for the offences P/U/S 489(B)(C), 120(B)

of IPC and Sections 3, 25, 27 of Arms Act and Sections
13, 15, 16, 17, 18 of Unlawful Activities Prevention Act.

      This Criminal Petition coming on for orders this
day, the Court made the following:


                        ORDER

Heard the learned counsel appearing for the petitioner and also the learned Government Pleader appearing for the respondent-State.

2. Learned counsel for the petitioner has submitted that the offences alleged are also under the provisions of Unlawful Activities Prevention Act, 1967 and the allegation against the petitioner is that he is involved in terrorist activities. In this regard, learned counsel has also relied upon the decision reported in 1994 AIR SCW 3857 in the case of Sanjay Dutt Vs. The State through C.B.I., Bombay.

3. I have perused the said decision and also the principle enunciated in the said decision. Therefore, 3 this matter is to be registered as criminal appeal and to be heard by the Division Bench of this Court and not by the Single Bench.

4. Therefore, Registry is directed to place the matter before the Hon'ble Chief Justice to obtain appropriate orders for placing the matter before the Division Bench. For statistical purpose, this petition is treated as closed since it is to be registered as Criminal Appeal.
