ORDER:(Per Hon'ble Sri Justice Joymalya Bagchi) We have perused the materials on record. The Writ Petition was filed alleging that respondent Nos.3 to 6 have not taken steps with regard to the complaint/representation of the petitioner by suspending the operation of 7th respondent company, which is allegedly carrying on operations in violation of existing laws.
Report is filed on behalf of 3rd respondent wherein it is stated as follows:
"It is further submitted that, on verification of the licenses possessed by the industry and on verification of production details it was observed that, M/s Sri Kalahasti Pipes Limited is operating the industry with valid licenses i.e., ECs obtained from Ministry of Environment, Forest & Climate Change (MoEF&CC), Government of India (GoI), New Delhi and CFE and CFO from Andhra Pradesh Pollution Control Board (APPCB) and also actual production capacity is within consented capacity."2
In the light of the aforesaid finding which is placed on record, we are of the opinion no order need be passed in the Writ Petition save and except observing that the 7th respondent company shall carry on its operations strictly according to the conditions engrafted in the licenses/permissions issued to it in accordance with law.
With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
