Section 106 in Criminal Rules of Practice and Circular Orders, 1990
106. Suspension of sentence:
- Whenever an Appellate Court orders the suspension of the execution of a sentence of imprisonment under Section 389 of the Code, it shall send a copy of the order to the Superintendent or Officer-In-charge of the Jail in which the appellant is confined.Note :- The effect of an order by an Appellate Court suspending the execution of a sentence of imprisonment pending disposal of an appeal, is that the appellant if detained in Jail, is to be treated, in all respects as an undertrial prisoner.
