2. The present Q.A. is filed aggrieved over the inaction of the pees representation of the applicant dated

The brief facts of the case are that the applicant, while working as RDMC, Pakal: a was i included in the list of eligible candidates for selection and appointment as Group' D' in the backlog vacancies for SC & ST, as a part of Special Recruitment Drive launched in the RMS *¥" Division. The applicant expressed his willingness to work in the Group'D' post. The applicant's name was forwarded to the competent authority for considering his selection. The applicant claims that though he is senior, he was not selected. Several representations were made but of no avail, Hence, the O.A.
4. The contentions ofthe applicant are that he was not communicated of the result of the selection. The jumlors fo the applicants were selected.
Being an ST candidate, not considering his case, would tantamount te atrocities on SC/ST personnel,

Respondents in their reply statement stated that the applicant was appointed as Grameen Dak Sevak with effect from 5.8.1993 and has. been continued in the said post ail 01.05.2002, He belongs to ST cammunity. As per the seniority Hst of the Gramina Dak Sevaks maintained in the Prakasam Division, the applicant is placed at SINo.657. A Special Np, % 5 Hi tenet Recruitment Drive was conducted to All up the Group "D° pasts agains! SC/ST backlog vacancies In RMS 'Y¥Y" Division. In view of the fact that there were no eligible Grameena Dak Sevaks in ST category in RMS OY Division, nominations were calle d for from eligible 2 Grameen Dak Sevaks from ST categary from all the [3 Postal Divisions which come under the eNurisdi ction of Vuayawada Postal Region, including Prakasam Division in which the apphcant is presently working. From the Prakasam Postal Division, the consolidated list af [0 senior GDS officials belonging to ST community was forwarded for selection against Group "D° post. There were 11 Group 'D' vacancies to be { filled up in RMS 'Y? Division, out of which one vacancy was filled from the eligible part time casual labour iy working in SRO, Guntur. For the remaining 10 vacancies, 112 applications were received from 13 Postal Divisions and combined seniority list was drawn, out af which $0 applications were taken into consideration for promotion to the cadre of Greup' D" at the rate of 1:5 ratio of the vacancies. Only 3 GDS officials pertaining to Prakasam Division from ST community nave come under the zone. of consideration. However, the said candidates could not be selected as they did not fulfill the eligibility conditions like age, educational qualifications, etc. prescribed under the relevant recruitment rules. Thase SEV vho are eligible as per rec ruliment rules, were selected. The applicant was not selected since he did not come under the zone of consideration fer the 10 wacancies referred to. 6. Learned counsel for the applicant is absent. Heard Smt. L. Pranathi ss Reddy, learned counsel for the respondents. Records on file were perused in detail. The case pertains to the year 2014. The case came up for hearing HPSS Es son 7 oveasions. Hence, the OLA. is disposed of based on the records available.
one vie The iss ue is about the selection of the applicant to the post of Group "D' category. The respondents in order to fill up the backlog SCIST vacancies of Group "DY in RMS Y dn, have conducted a Special Reeruittment Drive. There were }! vacancies to be filled m RMS ¥° Division. As there were no SCYST candidates available in the RMS ¥° Division, the respondents have called for applications from 13 Posta! Divisions which core under Vijayawada Postal Region. The respendenis 'received 112 applications... A combined seniority list was drawn from which 50 applications were taken at the rate of 5 applications per post. Though 11 vacancies were available, one of the vacancies was filled up by a casual labour as per relevant rules. Hence, for 10 vacancies, 50 applications were taken by the respondents for consideration, out of which LO senior most GDS officials were selected. The details are given below:

No junior to the applicant was selected to the post af Group "DY apainst the SC/ST backlog vacancies. As per rules, the seniors have to be first selected and hence, the action of the respondents cannot be found fault with. The applicant did not come in the zone of consideration as q well. Therefore, we find no meritin the O.A. and hence, it is dismissed with ne order as to costs.
