21 13-08-2015Heard learned counsel for the parties.
There is a piquant situation in which this Court is placed in deciding there this writ applications which would definitely require the date on which Chapter-16B of the Bihar University Calendar containing statutes namely, "number of grades, qualification, pay scale, mode of appointment of teachers and officers in the faculty of Ayurveda" came into force.
There could be possible three sources from which such date can be ascertained namely the learned Chancellor from where the statutes got assent or from the University where it came into force or even from the office of the State Government without whose prior consultation the statutes could not receive assent of learned Chancellor.
Mr. Rajendra Kumar Giri, learned counsel appearing for the learned Chancellor submits that all efforts are being made to trace out the relevant records for finding the date on which the aforementioned Patna High Court CWJC No.7246 of 2008 (21) dt.13-08-2015 9 statutes came into force and he expects that it with the assistance of the University the date of the aforesaid statutes coming into force can be brought on record by way of an affidavit to be filed by the Officer on Special Duty in the office of the learned Chancellor. He for this purpose prays for time till next Wednesday i.e. 19.08.2014.
Put up this case on Thursday i.e. 20.08.2015, when the Officer on Special Duty in the office of the learned Chancellor, shall remain present in person.
