PATEL Date : 28/01/2019 IA ORDER (PER : HONOURABLE MR.JUSTICE K.M.THAKER) Having regard to the fact that the decree for divorce/dissolution of marriage is not granted and the petition seeking divorce/dissolution of marriage is rejected by the Court and the husband has filed present appeal and also having regard to the fact that there is no evidence to demonstrate that the respondent herein is employed anywhere and she has independent source of income and also considering the fact that the respondent maintains herself from maintenance allowed by learned trial Court, we deem it proper to pass following order: [a] On condition that the appellant shall deposit Page 1 of 2 C/FA/69/2019 IA ORDER Rs.10,000/ which, after she enters appearance may be allowed to be withdrawn by the respondent (by separate order at that stage), Issue Notice returnable on 5.2.2019.
The amount shall be deposited on or before 5.2.2019.
[b] If the amount, as aforesaid is not deposited, then this order will not take effect.
