Prayer in the present petition is for grant of pre-arrest bail to the petitioners in FIR No. 33, dated 3.5.2007, registered under Sections 420, 465, 466, 467, 468, 471, 120-B IPC, at Police Station Sarhali, District Tarn Taran.

The only dispute in the present case for which the present FIR was lodged is that fraudulently the petitioners had withdrawn a sum of ` 5,500/- from the account of deceased Swaran Kaur after her death. The case set up by learned counsel for the petitioners is that the amount was withdrawn by husband of the deceased.

Considering the fact that dispute in the present case is merely of ` 5,500/-, for that the petitioners should not be taken in custody for investigation. Accordingly, the petitioners are directed to join investigation and appear before the Investigating Officer on 29.7.2011 at 10.00 AM and thereafter whenever summoned. However, in case of arrest, they shall be released on furnishing of bail bonds to the satisfaction of the Investigating Officer. They shall also be bound by all the conditions as contained in Section 438(2) Cr.P.C.

The petition stands disposed of.
