Information sought:
1. The Complainant filed an RTI application (offline) dated 09.11.2023 seeking the following information:
"1. मेरे वारा ी भुवन सेठ जी को े षत प दनांक 2-11-23 िजसक$ एक कॉपी आपको एवं DDE (zone-16) को भी द+ गई। उन दोन प पर आपके वारा जो कार0 वाई क$ गई उसक$ एवं 1श3ा वभाग Page 1 of 6 से जो कार0 वाई चल रह+ है तथा सभा से जो कार0 वाई चल रह+ है सभी प 9यवहार क$ फाईल नो टंग स हत स=या पत >त1ल प दान कर? ।
2.(1) आपके प स-SDG/2023/5717 दनांक 3.11-2023 के Point No.
2 म? मFने Permanent Recognition क$ कॉपी मांगी थी, परGतु आपने Board क$ दनांक 9-5-1961 क$ Provisional recognition क$ जो Iक 15-7-1960 से 14-7-1961 तक ह+ Valid थी, दान क$ गई कृपया मुझे MपNट सूचना दान कर? Iक व यालय के पास Permanent Recognition एवं उससे पहले 1मलने वाला Essentiality Certificate है या नह+ं य द है तो कृपया उसक$ कॉपी दान कर? ;
(ii) जब आपके संRान म? यह आ गया Iक व यालय चलाने के 1लए अहम दMतावेज Essentiality Certificate, Recognition, Scheme of Management approved by the D.O.E. FE Building Completion Certificate., School Authority के पास नह+ं है तो Mकूल का मUु खया होने के जाते >नयमानुसार आपने िजन-िजन Authorities / 1श3ा वभाग को बताने हेतु प 1लख? उन सभी क$ कॉपी दान कर? Wय Iक यह आपक$ Duty बनती है / थी। 1श3ा वभाण DSEAS R, 1973 के अनुसार उपरोWत Certificates एवं Som के बाद ह+ 951, Grand-in-aid दान करता है ।

(1) हमारे Mकूल म? आने एवं जाने का 1सफ0 एक ह+ गेट है तो Iफर 6+1 = 7 Security Guard अथथा0त दन के समय सुबह 7.00 बजे से शाम 7.00 बजे तक ी \चीरे न जाना स हत तीन security Gund िजस Criteria (मानदं ड) के आधार पर रखे गए है उसक$ कॉपी दान कर? Wय Iक यह सरकार+ धन को सीधे तौर पर नुकसान पहुंचाया जा रहा है। (ⅱ) हमारे व यालय म? तैनात Security Guards िजस कंपनी से आए है उसका पूरा पता तथा मो० ज० एवं Supervisor का नाम एवं पता (काया0लय का) बताने क$ कृपा कर? ।
4. दनांक 5-7-2008 को SMC क$ एवं दनांक 16-12-2022 क$ तथा उसके बाद क$ मुझेसच ू ना दान करने तक जब-जब SMC क$ meeting हुई तथा उनम? जो भी Mताव पास Iकए गए सभी क$ कॉपी दान कर? ।
5. दनांक 30.10-2023 को व यालय वारा Mकूल के िजन-2 Employees को MपNट+करण दया गया उनका नाम बताएँ तथा उसक$ Page 2 of 6 कॉपी तथा उसका जो जवाब वाब Employees वारा दया गया उसक$ कॉपी तथाउन पर School Authorities वारा जो कार0 वाई क$ गई उसक$ भी फाईल नो टंग स हत कॉपी दान कर? ।
6(i) आप (HoS.) एवं ी के. पी. 1संह दनाँक 12.6.16 से 16.6.16 तक •LT LTC (लेकर लेकर गए; गए; आप दो ब\च क$ बजाय तीन ब\च को >नयम वe ध लेकर गाए तथा आप दोन ने यह गलत Undertaking ह+ Iकक airline से Mवयं Tickets आपने Agent के वारा Tickets ल+ तथा Agent को कहे अनस ु ार ह+ 1सिWकम म? eके उसके Package के ल+ जबIक आपने अनुसार ह+ गाए थे। कृपया मुझे दनांक 10-5-19 को आपको Audit Memo Ha 10 तमासी K. P. Singh memo No.09 दया गया उसक$ दनांक 16-5-19 को आपने उनका जो जवाब दया उसक$ 1श3ा वभाष के Sanction Orders क$ िजस पर िजस आfधकार+ ने LTC Bills Sanction Iकए उनके हMता3र हो उसक$ तथा Filet. SDG/2016/3715 एवं 3716 दनांक 30-6-2016 जो Accounts officer को जमा कराई गई उसके सभी दMतावेज क$ फाईल नो टंग स हत स=या पत >त1ल प दान कर? ।
(ii) अब उWत दोन फाईले िजसक$ Custody म? है उसका नाम एवं पद बताएँ।"
2. Having not received any response from CPIO, the complainant failed to file a First Appeal.
3. Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant Complaint.

4. The following were present:-
Complainant: Present in person.
Respondent: Shri Kanwar Pal, APIO-cum-Officiating Vice Principal and Shri K. Syeed, Legal Advisor, attended the hearing in person.Page 3 of 6
5. The Complainant stated the Respondent has provided a reply qua the instant RTI Application vide letter dated 16.12.2023 and the same is beyond the stipulated timeframe as per the provisions of RTI Act.
6. The Respondent submitted that their office has received the RTI Application on 10.11.2023 and based on available records, the relevant information was given to the Complainant vide letter dated 16.12.2023 containing 13 pages, stating as under:
"1. आप पैसे मु दे उठा रहे हF िजनक$ Mकूल से कोई ासंfगकता या संबंध नह+ं है Wय Iक क$>त0 नगर ी सनातन धम0 सभा के अgय3 होने के नाते भव ु न सेठ जी क$ Mकूल म? कोई भ1ू मका नह+ं है ।
2. (i) उपलhध माण प क$ >त आपको दान क$ जा चुक$ है । संब धता के आवेदन के समय भी यह+ माणप 2 सीबीएसई को सiपा गया था।
(ii) Mकूल को वभाग ने 02.08.1977 को अपने अधीन ले 1लया था और 14.08.1986 को जब इसे वापस लौटाया गया तो कई फाइल? और प नह+ं नह+ं सiपे गए। बंधन योजना (SOM) को वभाग के आदे शानस ु ार हाल ह+ म?
स3म ाfधकार+ के अनुमोदन के 1लए पुनः Mतत
ु Iकया गया है ।
3. (i) (ii) उिmलUखत पद पर कोई टnपणी नह+ं द+ जा सकती Wय Iक ये पद वभाग वारा Mवयं भतo Iकये गए हF व यालय ने अपनी तरफ से कोई मांग नह+ं रखी थी और वभाग वारा अपने ववेकानस ु ार सभी व यालय म? इसक$ आप>ू त0 क$ जाती है ।
4. इस तरह क$ सच ू ना (अनरु ोध के अनस ु ार 05.07.2008 से अभी तक) नह+ं द+ जा सकती RTI act म? ऐसा कोई ावधान नह+ं है क$ आप अ>निqचत समय के ू ना मांगे, ऐसा करके आप व यालय व छा 1लए सच का बहुमm ू य समय नNट कर रहे हF 5-6. ये परू + तरह से कम0चाsरय के 9यिWतगत और >नजी मामले हF और तदनस ु ार इस पर कोई जानकार+ नह+ं द+ जा सकट+ Wय Iक यह 9यिWतगत और >नजी मामल म? हMत3ेप है । इसके अलावा, यह नोट Iकया गया है Iक Page 4 of 6 आप अवांछनीय ग>त वfधय म? 1लnत हF िजनक$ एक 1श3क से अपे3ा नह+ं क$ जाती है जैसा Iक नीचे उिmलUखत कुछ उदाहरण से दे खा जा सकता है ।
(i) थम अपील+य ाfधकार+ ने 28.12.2021 क$ आपक$ अपील पर दनांक 28.01.2022 के अपने आदे श म? आइटम नंबर 1 और 2 के तहत सीसीट+वी फुटे ज और 01.4.2021 और 24.09.2021 क$ एसएमसी बैठक के काय0वt ृ के मु द को आरट+आई आवेदन म? शा1मल नह+ं Iकया गया था, लेIकन FAA को अपील म? ये शा1मल Iकया गया था। ऐसा काय0 सव0धा अनfु चत है व Mवीकाय0 नह+ं है
(ii) आपने माननीय सीआईसी को दनांक 21.02.2023 को एक अपील दायर क$ जहां >नuन1लUखत अ>नय1मतताएं पाई गई थी आरट+आई आवेदन आरट+आई अfध>नयम 2005 के खंड 7-1 के तहत 48 घंट म? सच ू ना आप>ू त0 के ावधान का पालन Iकए बना दायर Iकया गया था। 30 दन क$ समािnत के बाद FFA के सम3 अपील दायर करने के बजाय, आरट+आई आवेदन के ठ क 4 दन बाद सीआईसी म? अपील दायर क$ गई थी।
ये MपNट करता है क$ आप Iकस तरह RTI के ावधान का उलंघन करते हF।
आव यक सलाह : भ वNय म? RTI के अfधकृत ाxप म? ह+ आवेदन कर? व अपना आवेदन सच ू ना मांगने तक ह+ संy3nत करे ताIक व यालय का समय नNट न हो और व याfथ0य क$ पढ़ाई बाfधत न हो। आप बार बार CIC म? दे ख लेने क$ धमक$ दे ते हF और ऐसा आभास दे ते हF क$ CIC आपक$ जेब म? है, इस कार Iकसी भी माननीय वभाग के बारे म? कहना बलकुल भी Mवीकाय0 नह+ं है। आप बार बार >नजी व गोपनीय जानकाsरय को RTI के माgयम से लेते हF ु पयोग करते हF, 1शकायत? करते हF व अGय कम0चाsरय को धमकाते व उसका दx हF इस कारण व यालय का बहुमm ू य समय नNट हो रहा है व छा क$ पढ़ाई भी बाfधत होती है"
Decision

The Commission observed that the present complaint was filed under Section 18 of the RTI Act, 2005 where the Commission was only required to ascertain if the information has been denied with a mala fide intent or due to an unreasonable cause or under any other clause of Section 18 of Page 5 of 6 RTI Act. In this regard, the Commission relies on one judgment of Hon'ble Supreme Court in "Chief Information Commissioner & Anr. Vs. State of Manipur & Anr." bearing CIVIL APPEAL NOs.10787-10788 OF 2011 decided on 12.12.2011 has held as under:-
"Therefore, the procedure contemplated under Section 18 and Section 19 of the said Act is substantially different. The nature of the power under Section 18 is supervisory in character whereas the procedure under Section 19 is an appellate procedure and a person who is aggrieved by refusal in receiving the information which he has sought for can only seek redress in the manner provided in the statute, namely, by following the procedure under Section 19. This Court is, therefore, of the opinion that Section 7 read with Section 19 provides a complete statutory mechanism to a person who is aggrieved by refusal to receive information. Such person has to get the information by following the aforesaid statutory provisions. The contention of the appellant that information can be accessed through Section 18 is contrary to the express provision of Section 19 of the Act. It is well known when a procedure is laid down statutorily and there is no challenge to the said statutory procedure the Court should not, in the name of interpretation, lay down a procedure which is contrary to the express statutory provision. It is a time honoured principle as early as from the decision in Taylor v. Taylor [(1876) 1 Ch. D. 426] that where statute provides for something to be done in a particular manner it can be done in that manner alone and all other modes of performance are necessarily forbidden."
8. The above ratio is applicable to this case as well. Since records of the case do not indicate any such deliberate denial or concealment of information on the part of the PIO, the Commission concluded that there was no cause of action which would necessitate action under the provisions of Section 20(1) of the RTI Act, 2005 in the instant complaint.
The Complaint is dismissed accordingly.
