09.10.2014Apprehending their arrest in connection with Jaggarnathpur PS case No. 223 of 2011 registered under sections 366A/376/120-B of the Indian Penal Code, the petitioners pray for grant of anticipatory bail .
Heard the learned counsel for the petitioners and the learned counsel for the State.
Prosecution case, in short, is that the daughter of the informant was kidnapped on 29.8.2011 and at that time, she was aged only 17 years .
It appears from the record that the daughter of the informant was recovered and her statement was recorded under section 164 Cr.P.C. Wherein she has admitted her marriage with Pawan Das (Petitioner no.2). It further appears that matriculation certificate showing the date of birth of the victim girl was produced in which the date of birth of the victim girl was shown as 27.9.1988.
Learned counsel submitted that the girl was major on the date of the alleged offence and she has voluntarily married with the son of petitioner no. 1.
Learned counsel for the State fairly admitted that the girl was major on the date of the occurrence.
Having regard to the the facts and circumstances of the case, both the petitioners above named, in the event of their arrest or surrender before the court below within a period of two weeks positively from the date of this order, shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi, in connection with Jaggarnathpur PS case No. 223 of 2011 ( G.R. No. 4353 of 2011) subject to the conditions laid down under section 438(2) Cr.P.C.
