ORDER
1. The above case has been posted to today for further hearing.
2. Heard the learned counsel appearing for the Project Proponent at length for some time. Since there is no time, as the Hon'ble Expert Page 1 of 2 Member has to attend the Court No.2 and also considering the importance of the issue raised, we feel that some time can be granted to the parties to argue elaborately on the question as to how the ban of certain categories of industries to be established in the eco-sensitive zone in the Western Ghats issued by the MoEF&CC has been overcome by the MoEF&CC while this project was considered and the Environmental Clearance was granted.
3. The learned counsel appearing for the MoEF&CC wanted some time to get instruction in this regard.
4. The MoEF&CC is directed to furnish the entire file relating to issuance of Environmental Clearance including the Expert Appraisal Committee's file which appraised the project before the next hearing date.
5. The Registry is directed to communicate this order to the MoEF&CC by e-mail for their information and compliance of directions.
6. For further hearing, post on 01.07.2022.
