Section 52(1) in The Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961
(1)In the event of a vacancy in the office of President or Vice-President by reason of death, resignation, removal or otherwise, the vacancy shall, subject to the provisions of sections 42 and 50, be filled as conveniently as may be by election of a new President or Vice-President [who shall hold office only so long as the person in whose place he is elected would have held it, had the vacancy not occurred] [ These words were inserted by Maharashtra 34 of 1997, Section 3]:Provided that, if for any reason the offices of the President and Vice-President become vacant simultaneously [or if the President and Vice-President are on leave together] [These words were inserted by Maharashtra 8 of 1966, Section 3.], the Chairman of a Subjects Committee chosen by lot drawn by the chief Executive Officer in such manner as he deems fit shall, pending the election of the President, [or as the case may be, until either the President or Vice-President resumes duty] [These words were inserted by Maharashtra 8 of 1966, section 3.], exercise the powers and perform the duties of the President.
