By way of this stay petition, the assessee seeks a stay on collection and recovery of the tax and interest demands aggregating to Rs. 14,39,790/-, which are impugned in appeal before us in assessee's appeal for the Assessment Year 2014-
15.
2. At the outset, when this stay application was called the ld. Counsel for the assessee did not press stay application however pleaded for early hearing. The ld. D.R. for the Revenue has fairly agreed that an early hearing may be granted to the assessee.
3. We have heard both the parties and perused the material available on record. Keeping in mind the submissions made by the assessee and also keeping in mind Shri Asish Kumar Ghosh SA No. 58/Kol/2019 (Arising out of I.T.A. No. 1164/Kol/2019) Assessment Year:2014-15 the existence of the prima facie case, we are of the view that an early hearing should be granted to the assessee. The appeal is accordingly directed to be fixed out of turn hearing on 24.07.2019. The date of hearing out of turn was announced in the open court, hence no separate notice of hearing will be sent to the parties.
4. In the result, the stay application of the assessee is rejected and early hearing is granted.
Order is pronounced in the open court on 21.06.2019.
