1. Though this matter was heard at some length, Mr. Neeraj Grover, learned Counsel for Defendant No. 1, points out that even as per the recitals in the plaint, Defendant No. 1 has been selling its products at least since September, 2020.

2. In view thereof, he submits that he ought to be granted an opportunity to respond to this application before this court considers the application for grant of interim reliefs.

3. The request has merit.

4. In view thereof, issue notice on this application.

5. Mr. Neeraj Grover accepts notice on behalf of Defendant No. 1.

6. Let a response to this application be filed within two weeks from today with advance copy to learned Counsel for applicants/plaintiffs, who may file rejoinder thereto, if any, before the next date of hearing.

7. List this application for hearing and disposal qua Defendant No. 1 on 18th August, 2021. As this matter was heard at considerable length on two dates, it shall be reflected as part-heard on the next date of hearing.

8. Qua Defendant Nos. 2 and 3, the plaintiffs have also alleged infringement of its registered design by the products of other defendants, which are advertised and made available on the flipkart.com website, which does not, however, disclose the details of the manufactures or sellers of the products.

9. The sellers have, therefore, been representatively impleaded as Defendant No. 3 under the head "John Doe".

10. There is no appearance on behalf of Defendant No. 2 in the present proceedings today.

11. Issue notice to Defendant No. 2, returnable on 2nd August, 2021. Notice would issue to Defendant No. 2 by all modes including through M/s Jyoti Sagar & Associates, who have been retained by Defendant Signature Not Verified Digitally Signed By:SUNIL SINGH NEGI CS(COMM) 253/2021 Page 2 of 10 Signing Date:27.07.2021 08:50:02 No. 2 in other matters which are pending before this Court.

12. M/s Jyoti Sagar & Associates is, therefore, directed to accept notice on behalf of Defendant No. 2 and inform Defendant No. 2 of the order passed today.

13. Despite this, if Defendant No. 2 does not appear on the next date of hearing, the court may proceed ex-parte against Defendant No.2.

14. On the next date of hearing, Defendant No. 2 is directed to disclose the names and addresses of the sellers of the products at serial nos. 1, 2, 4, 5, 7, 8, 9, 11 and 12 of the table in para 25 of the plaint. For ready reference, the table is reproduced hereunder:
