On behalf of State, Mr. Sandeep Vashisht, DAG Haryana, accepts notice.

Petitioner is aggrieved by the order dated 30.1.2019, endorsed on 1.2.2019 (Annexure-P-4), passed by Divisional Commissioner, Karnal Division, Karnal, vide which his application for grant of parole, has been dismissed.

Petitioner was convicted under Section 18 (b) of the NDPS Act, 1985. The parole has been declined on the ground that he falls in the category of hardcore prisoner and he has not completed the period of more than five years in custody. As per Rule 2 (aa) (i) (xiii), if a person has been convicted under Section 18 (b) of NDPS Act, 1985, he falls in the category of hardcore prisoner. It being so, he has no ground to grant parole before completion of five years of custody period. There is no ground to interfere in the impugned order. Thus, writ petition is dismissed.
