Heard on I.A. No.4745/2023, which is an application for disbursement of awarded amount deposited by Insurance Company.
Learned counsel for respondent submitted that financial condition of claimants is very bad. They have not yet received awarded amount granted by learned Tribunal. The appeal will likely to take time to be disposed of. In these circumstances, deposited amount be disbursed.
Learned counsel for the appellant/Insurance Company opposed the said application.
Considering the facts and circumstances of the case, the respondents no.1 and 2/claimants are permitted to withdraw 60% of the amount deposited by the appellant-insurance company subject to furnishing of adequate surety and remaining amount shall be kept in FDR at Nationalized Bank for fetching regular interest and the same shall not be disbursed without leave of this Court.
Accordingly, I.A No. 4745/2023 stands disposed of. List this case for final hearing in due course. C.C. as per rules.
