I am informed that similar issue is pending consideration before a Constitution Bench of the Apex Court in C.A. No. 3453 of 2002 (Jindal Stainless Limited & Another Vs State of Haryana & Ors).
I am also told that the State of West Bengal has taken steps to intervene in the said matter before the Apex Court.
Under such circumstances, I consider it prudent to adjourn this bunch of matters sine die.
Liberty to mention.
Assessment may continue and demand notice may also be served on the petitioner. However, no coercive action for realisation of such demand shall be taken by the State without leave of the Court. 2 The petitioner need not assail the demand notice during the pendency of the writ petition.
