                    J U D G M E N T

This writ petition is filed by the petitioner seeking to quash Ext.P9 order whereby a direction was issued to recover an amount of Rs.43,623/- (Rupees forty three thousand six hundred and twenty three only) from the petitioner and for other related reliefs. Contention raised by the petitioner in this writ petition is that petitioner was provided with the charge of various managerial posts at different points of time in the first respondent. It is urged by the petitioner that, petitioner is entitled to get charge allowance for the post officiated by the petitioner in various capacities. In that regard petitioner has submitted Ext.P10 representation before the first respondent and the same is pending consideration. It is for the first W.P.(C)NO.20634 OF 2016 2 respondent to take a decision with respect to the claims raised by the petitioner. According to the petitioner, Ext.P10 is pending consideration with effect from 01.06.2012 before the first respondent. True, the immediate reason for the petitioner to invoke the writ jurisdiction is Ext.P9 wherein there is a direction to recover certain amounts from the petitioner. According to the petitioner if the charge allowance is provided to the petitioner the recovery need not be effected as sought for under Ext.P9. It is in this background this writ petition is filed.

Having heard the learned counsel for the petitioner, learned Government Pleader and the counsel for the first respondent, there will be a direction to the first and second respondents to take a decision on Ext.P10 representation submitted by the petitioner within a period of one month from the date of receipt of a copy of this judgment. If any co-ercive action is initiated pursuant to Ext.P9, same shall be kept in abeyance for a period of 45 days. Thereafter it W.P.(C)NO.20634 OF 2016 3 will be guided by the decision taken on Ext.P10.

The writ petition is disposed of accordingly.
