                Alleging   violation/willful   disobedience   of   the   order   dated 
          05.10.2012

 passed in W.P.(S) No. 5312 of 2012, the petitioner has  filed this contempt petition.

The   writ   petition   was   disposed   of   by   directing   the   2nd  respondent to consider the representation of the petitioner and to  pay arrears of post retiral benefits without any further delay.

Petitioner   is   represented   by   the   learned   counsel   Mr.   Rajni  Kant   Ojha   and   the   opposite   party­JSEB   is   represented   by   the  learned counsel Mr. Amit Kumar.

The   opposite   party   No.1   has   filed   a   show   cause   dated  16.07.2013   stating   that   in   compliance   of   the   order   dated  05.10.2012   passed in W.P.(S) No. 5312 of 2012, the pension and  gratuity   of   the   petitioner   has   been   revised   as   per   the   6th  Pay  Revision   vide   letter   No.   59   dated   17.01.2013   and   the   following  amount has been paid to the petitioner;

1.   Pension   Arrears:   ­   Rs.   79860/­   only   vide   cheque   No.  993673 dated 25.02.2013.

2.   Gratuity:­   After   deduction   of   quarter   rent,   Rs.   445452/­  vide cheque No. 993664 dated 13.02.2013.

3.   Leave   encashment   (Unrevised):­   Rs.   307963/­   only   vide  cheque No. 996358 dated 07.02.2013.

4.  Leave enchashment (Revised) :­ Rs. 60807/­ only vide  cheque No. 993673 dated 25.02.2013.

5.   Pension   Commutation   :­   Rs.   240216/­   only   vide   cheque  No. 996358 dated 07.02.2013.

It is also stated that G.P.F. and G.S.S.  were already been paid  to the petitioner.

Since all the retiral dues  as  well as in revised rate (as per 6 th  P.R.C.) has been paid to the petitioner, the order dated 05.10.2012  passed in W.P.(S) No. 5312 of 2012  is fully complied with.

Accordingly, this contempt proceeding is dropped.
