The Complainant has sought the following information:
- Acquisition proceedings and other related records from 1940 till date in respect of Survey No. 34 of village Chidri Tq. Bidar for Air Force Station Bidar.1
Grounds for Complaint The CPIO did not provide any information.
Submissions made by Complainant and Respondent during Hearing: The complainant has in both the complaints sought for the information to be provided, action to be taken against the CPIO, and monetary compensation be given to him for the mental agony caused. He also sent written submissions dated 20.03.2022 reiterating the same points as given in the complaints also informing that he will not attend the hearing.
The CPIO from DGDE Bangalore was not present as the notice was returned stating that the address was insufficient and for DGDE, Bidar who also failed to attend the hearing it was stated that no such person was available at the address. However, the concerned CPIO when contacted over phone stated that a reply was given to the complainant on 26.10.2020. She was asked to send a copy of the same to the Commission for perusal.
Observations:
From a perusal of the relevant case records, it is noted that initially the RTI application was transferred from dept of Posts to the Estate Officer, Air Force Station, Bidar dated 07.09.2020. After receipt of both the RTI applications mentioned above, the concerned CPIO, DGDE, Bangalore had provided a reply to the complainant on 26.10.2020 whereby it was stated that the requisite information cannot be processed as there is no information sought. However, the complainant was provided an opportunity to inspect the records on any working day on prior intimation. The Commission is unable to find any flaw in the reply given and therefore the complaints are not established. However, the concerned CPIO is directed to send a copy of the reply dated 26.10.2020 to the complainant.
Decision:
In view of the above, no action lies.
The complaints are disposed of accordingly.
