ORAL ORDER
3 06-08-2014Since both the applications arise out of one case, they are being taken up together and are disposed of by this composite order.
Heard the parties Both the petitioners, apprehending their arrest in connection with a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code, are named accused in this case with allegation of pulling down the informant's son from pipe and dragged him behind a bridge and got him injured by stone pieces.
Submission is of false implication due to previous enmity and Patna High Court Cr.Misc. No.21430 of 2014 (3) dt.06-08-2014 2 it was a case of accidental death.
Having regard to the facts and circumstances emerging from the investigation including inquest report, column - v, none of these two petitioners appear entitled for the privilege sought. Accordingly, the prayer for anticipatory bail of the abovenamed petitioners, in connection with Khaira P.S. Case No. 13 of 2014 pending before Chief Judicial Magistrate, Jumai, is hereby refused.
