Case is taken up for hearing through video conferencing. Short reply by way of affidavit of the Superintendent, Central Jail, Ludhiana, has been filed through e-mail. Print out of the same is taken on record.

Through this petition, the petitioner seeks interim regular bail in case bearing FIR No.40 dated 21.06.2019, registered at Police Station Aur, District SBS Nagar, under Sections 22 and 29 of NDPS Act, 1985.

As per the prosecution version, recovery of 1020 tablets of Alprazolam and 2400 tablets of Clovidol was effected from the petitioner.

Learned counsel for the petitioner contends that the petitioner is a patient of Hepatitis-C besides being HIV+ve; that there are chances that health of the petitioner may get worsened day by day due to Covid-19 pandemic and that the petitioner may be released on interim regular bail.

On the other hand, learned State counsel opposes the prayer 1 of 2 ::: Downloaded on - 04-09-2020 01:21:19 ::: -2- CRM-M-22433-2020 made in the present petition, but does not dispute that the petitioner had remained admitted in the Civil Hospital, Ludhaina. He also states that out of 11 prosecution witnesses, 07 witnesses have since been examined.

I have heard the learned counsel for the parties.

The factum of the ailment of the petitioner is not disputed. Still further, there are chances that his health may deteriorate day by day due to Covid-19 pandemic.

In view of the above, without commenting anything on the merits, the present petition is allowed and the petitioner is ordered to be released on interim regular bail for a period of four weeks from the date of his release, subject to his furnishing personal and surety bonds to the satisfaction of learned trial Court/Duty Magistrate, SBS Nagar. The trial Court/Duty Magistrate, SBS Nagar, shall specify the date on which the petitioner shall surrender in jail after his release for a period of four weeks to be counted from the date of release.
