Issue notice to respondent on payment of process fee by RAD mode
within seven working days, failing which the present petition shall stand dismissed without further reference to the Court. Notices be made returnable within four weeks.
Learned counsel for the petitioner submitted that Clause (d)(i) of Article 6 of the Schedule 1-A of the Indian Stamp Act would be attracted since the agreement contains the construction of building, model house and thereafter development and then sale.
In the meanwhile, further proceedings in Arbitration Case No.03/2022 pending before the learned Arbitrator shall remain stayed till the next date of hearing.
