1. This Petition is filed on behalf of the Petitioner under Section 11(5) and (6) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of the Sole Arbitrator.

2. Disputes having arisen between the parties in relation to Work Order dated 03.03.2015, whereby Petitioner was awarded the work of "Balance Civil and Structural Work of 3 Towers-K, L and M at Respondent's Group Housing Project Park Serene Spacio, Sector 37 D, Basai, Gurgaon", Petitioner invoked the arbitration clause and sent notice dated 19.09.2024 for appointment of the Arbitrator but there was no response. As per the Petitioner a sum of Rs.4,09,93,158/- is due and payable to the Petitioner from the Respondent.

3. Learned counsels for the parties jointly submit that settlement talks have failed between the parties and hence the Court may appoint a Sole ARB.P. 33/2025 Page 1 of 2 This is a digitally signed order.

4. Accordingly, with the consent of the parties, Mr. Vinay Kumar Khanna, Principal District & Sessions Judge (Retd.) (Mobile No.9910384719) is appointed as Sole Arbitrator to adjudicate the disputes between the parties. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre ('DIAC'). Fee of the Arbitrator shall be fixed as per fee schedule under DIAC (Administrative Cost & Arbitrators' Fees) Rules 2018.

5. Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

6. It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the parties are left open.

7. Petition is disposed of in the aforesaid terms.
