That the petitioner(s) are citizen of India and as such have every right to invoke the inherent jurisdiction of this Hon'ble court for the protection and enforcement of his legal rights. The petitioner is preferring this instant writ petition under article 226 of constitution of India against respondents arbitrary, illegal and unwarranted acts. The respondents in complete violation of the statutory duty have acted in a prejudicial manner of the detriment of petitioners and others. Petitioners is agreed of action of respondents as he not being allowed to participate in the new e-NIT NO SKIMS MCH 05 of 2020 Dated 17.08.2020 which is hereby annexed as Annexure I SINR Page No 10 * 2... The respondents has allotted through one Allotment No, SIMS-217/e-NIT 02/2018-19/276-81 dated 03/07/2019 a contract for supplying, testing and commissioning of CCTV, Fire detection/Alarm system and public address system at State Cancer Institute Block, SKIMS Soura and with regard to the said allotment petitioner started the work and thereafter his contract was not allowed to proceed further. In this regard the petitioner filed a writ petition in this Hon'ble court bearing no WPC NO 3485/2019 whereby this Hon'ble Court passed an order dated 02.12.2019 the copy whereof is annexed as Annexure II whereby court directed respondents to consider and decided the request of petitioner for extension of time within a period of two weeks and furthermore respondents were directed to take decision on merits and till then the re-tendering was stopped by the Hon'ble High Court. 3. Notwith standing the earlier order passed by this court the respondents | issued the fresh tender which is annexed as Annexure I and thereafter issued several extension notices to this said e-NIT No 05 of 2020 dated 17.08.2020. The first extension was issued upto 25/09/2020 copy whereof is annexed here with as Annexure ITI. Thereafter the second extension notice was issued upto 14/10/2020 copy whereof |is annexed herewith as Annexure IV. It is pertinent to mention that the third corrigendum/extension notice was issued and the date was furthermore extended upto 22/10/2020 copy whereof is annexed as Annexure V. 4. That petitioner has already filed and FDR and deposited amount is 1,60,500 (one Lakh Sixty Thousand Five hundred Rupees) dated 14/09/2019 which a produced for participating the said e-NIT copy <_ ONG canestett_---- ae Page No 11 whereof is annexed as Annexure VII. Besides this petitioner has also submitted a DD of five thousand rupees bearing no 666558 dated 17/09/2018 copy where of annexed as Annexure VI. Despite this the petitioner is not being allowed to participate in the said NIT. 5. That needless to state petitioner has earlier also accomplished tender with the said hospital and has been applauded by the respondents the testimonials to the said fact are annexed herewith as Annexure VIII. 6. The petitioner therefore approaches this Hon'ble court inter-alia on the following ground without prejudice to one another. I) For that petitioners constitutional as well as statutory rights cannot be flouted in official respondents of bound to follow the due process of law II) For that the impugned action on the part of respondents are not allowing to participate in the new/fresh NIT which is annexed as Annexure I is vitiated by malafides unreasonableness and arbiteriness. The respondents without agherance to the terms and conditions and willfully flouting the earlier High court order has unilaterally passed the fresh NIT and are not considering the petitioner to participate the said NIT. III) for that petitioner already deposited the earnest money and is fully capable and qualified to execute the contract but unfortunately earlier he - could not complete the said work due to the prevailing situation and thereafter in the wake of COVID 19. Infact in terms and conditions notice tender it is specifically mentioned that any failure or omission to carry out the provisions of the work order shall not give rise any claim by the en IV) V) Page No 12 department and bidder one against other. If such failure or omission arises from an act of God which includes the civil strike, lockout or from any reason on control of parties. The delay is absolute beyond of the petitioner Infact he is even today most willing to complete the work provided his time is extended by a reasonable measure. Despite this all the petitioner is now yet again willing to participate in the fresh NIT which is Annexed as Annexure I but the respondents are not allowing him to do so. The action of the respondents is capricious and arbitrary is so far as it is done to the determent of petitioners rights to livelihood and smacks of irrationality. It also abhors equality. For that respondents are not permitted under law to violate the rights and legitimate interest of petitioner. The respondents state is custodian of law and rights to the subject. The respondents being a welfare state has an obligation to see that injustice is not done to any person in process of passing any order for the benefit of any individual. It is submitted petitioner has invested huge amount in execution! of the work allotted as he has procured material from Bangalore and 'Chennai and elsewhere. The impugned in action on the part of respondents is capricious as petitioner was not allowed to participate in the Fresh NIT. For that petitioner has series of meeting with the respondents right from the month of July 2019. And has infact assured them of timely completion of the project. But nothing tangible has been done for the part of respondent. Moreso, petitioner has already take overdraft/loan from bank and has placed orders procured material. It will cause huge loss to the petitioner if he is not allowed to participate in the said NIT. Page No 13 a VI) 'For the decision of respondents can be tested on wednesbury principle of reasonableness and the decision of institute of medical sciences should ought to have been free from arbitrariness and not affected by bias or actuated by malafidies. VII) That the Petitioners is left with no alternative remedy expect invoking the extra ordinary jurisdiction of the Hon'ble High Court. Petitioner has not approached any other court of law including Supreme Court of India. 7. That the petitioners seeks concession of this Hon'ble Court to raise any other point/ Submission as available at the time fo arguments and petitioner reserves his right to do so. 8. That an affidavit is duly sworn by the petitioners in support of present situation which is enclosed herewith. The. PAVA system shall be properly integrated with the fire alarm-system. The integrated PAVA system shall cover all narmatly accessible areas including the car parks.
