The issue that has been highlighted in the present W.P(PIL) pertains to the permission granted by the Mines and Geology Department 2 to conduct mining operations in close proximity of an ancient stupa namely 'Bouddha Maha Dhatu Stupa' in Sy.No.133/1 of Kodavali Village, Gollaprolu Mandal, Kakinada District.

Reference in this regard has been made to a notification issued as early as in the year 1922.

Let response be filed within two weeks. The response should specifically state as to 1) whether any permission has been granted by the Mining and Geology Department to the concerned? 2) Whether the permission from the Archaeology Department has been obtained in that regard before obtaining permission? and

3) Whether the said monument has been declared as a protected monument in accordance with the provisions of Ancient Monuments and Archaeological sites and Remains (AMASR) Act, 1958 and if it has been so declared, the extent and boundaries thereof?

Let the needful be done within a period of two weeks.
