ORAL ORDER
7 31-08-2018Learned counsel for the petitioner, State, B.R.A. Bihar University and J.P. University (hereinafter referred to as the 'University') have assisted the Court.
2. In view of the pleadings on record, it appears that all retiral dues of the petitioner have been paid except for D.D.A. of which a certain portion has remained on account of lack or settlement between the two Universities for which the Registrars of both the Universities have been meeting and such matter has also been directed to be sorted out latest by 17th September, 2018. 3. The petitioner has also filed Interlocutory Application No. 6368 of 2018 for adding of further reliefs. Perusal of the same discloses that it relates to an in-service dispute of Ph.D increments. Such dispute cannot be termed as a retiral benefit matter and, accordingly, the Court does not find any ground to allow the prayer made in the Interlocutory Application.
4. At this juncture, learned counsel for the petitioner prayed for withdrawing the Interlocutory Application.
5. In view thereof, the Interlocutory Application No.6386 of 2018 stands dismissed as withdrawn. The petitioner shall be at liberty to move before the appropriate authority/ forum in connection with the relief sought in the Interlocutory Application.
6. In view of the issue relating to D.D.A., the present case be listed along with C.W.J.C. No.2171 of 2017.
