Background
1. The Applicant filed an RTI application dt.22.7.08 with the CPIO, BSNL, Faizabad. He requested for information against 7 points with regard to franchisee/dealers/distributors/wholesaler and tenderers including the importance of each category, the period taken for the franchisee appointment process. The CPIO replied on 28.7.08 providing point wise information. (CPIO's reply not in the file). Not satisfied with the reply, the Applicant filed an appeal dt.6.10.08 with the Appellate Authority stating that he has right to get photocopies of whatever documents he wants and that he needs photocopies. The Appellate Authority replied on 14.10.08 stating that the submissions from the tenderers were invited regarding providing copies of documents. However, the tenderers denied disclosure of information hence the information cannot be provided. Aggrieved with this reply, the Applicant filed a second appeal dt.22.10.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for May 6, 2009.
3. Mr. Ashwani Kumar, AGM represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that the Appellant had requested for photocopies of documents submitted by the bidders and that the same were denied after getting submissions from the third party. The Commission reviewed the appeal and the submissions and directs the CPIO to provide the comparative statement of technical and other details based on which the tender was awarded, including the parameters and marks awarded against ach parameter by each bidder. Information to be provided by 10th June, 2009. All other information has already been furnished to the Appellant.
6. The appeal is disposed off.
